1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of ImageTranslate ("Service," "we," "us," or "our") at imagetranslate.io. By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

ImageTranslate provides an AI-powered image translation service that allows you to translate text within images to over 100 languages while preserving design quality. The Service includes:

• Image upload and processing
• AI-powered text translation within images
• Download of translated images
• Credit-based usage system

3. Eligibility

You must be at least 13 years old (or 16 in the EU/EEA) to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Account Registration

4.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

4.2 Account Responsibility

You are responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from unauthorized use of your account.

5. Pricing and Payment

5.1 Credit System

The Service operates on a credit-based system. Each image translation costs one (1) credit. Credit packs include:

• Free: 3 credits (one-time)
• Starter Pack: 10 credits for $5.99
• Standard Pack: 25 credits for $12.99
• Pro Volume Pack: 50 credits for $24.99

5.2 Payment Terms

Payments are processed securely through Stripe. By providing payment information, you agree to pay all fees for credits purchased. All sales are final.

Credits do not expire and are non-refundable except as required by law.

5.3 Price Changes

We reserve the right to change our pricing at any time. Price changes will not affect credits already purchased.

6. Acceptable Use

6.1 Permitted Uses

You may use the Service for lawful purposes, including:

• Translating product images for e-commerce
• Creating multilingual marketing materials
• Localizing social media graphics
• Personal and commercial projects

6.2 Prohibited Uses

You agree NOT to:

• Upload images containing illegal content, hate speech, or adult content
• Violate intellectual property rights of others
• Use the Service to create misleading or fraudulent content
• Attempt to reverse engineer, decompile, or hack the Service
• Use automated tools to abuse or overload the Service
• Upload images containing personal data of others without consent
• Resell or redistribute the Service without authorization
• Use the Service to create competing products or services

7. Intellectual Property Rights

7.1 Your Content

You retain all ownership rights to images you upload ("Your Content"). By uploading images, you grant us a limited license to:

• Process and translate your images using AI technology
• Store your images temporarily (deleted after 24 hours)
• Display translated results to you

7.2 Our Content

The Service, including its design, software, and branding, is owned by ImageTranslate and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, or create derivative works of our content without permission.

7.3 Translated Images

You own the translated images generated by the Service and may use them for any lawful purpose.

8. Disclaimers and Limitations

8.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that:

• The Service will be uninterrupted, error-free, or secure
• Translation quality will meet your expectations
• Translations will be 100% accurate
• The Service will be compatible with all devices or browsers

8.2 AI Limitations

Our Service uses AI technology, which has inherent limitations. Translation quality may vary based on image quality, text complexity, and language combinations. You are responsible for reviewing and approving all translated images before use.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMAGETRANSLATE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Business interruption or system failures
• Any damages arising from your use or inability to use the Service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless ImageTranslate from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you upload to the Service

11. Termination

11.1 By You

You may terminate your account at any time by contacting us at support@imagetranslate.io. Unused credits will not be refunded upon termination.

11.2 By Us

We may suspend or terminate your access to the Service at any time, with or without notice, if:

• You violate these Terms
• Your use poses security or legal risks
• We cease operating the Service

11.3 Effect of Termination

Upon termination, your right to use the Service immediately ceases. Sections that by nature should survive termination (including indemnification, disclaimers, and limitations of liability) will survive.

12. Dispute Resolution

12.1 Informal Resolution

Before filing a formal dispute, please contact us at support@imagetranslate.io to resolve the issue informally.

12.2 Governing Law

These Terms are governed by the laws of the jurisdiction in which ImageTranslate operates, without regard to conflict of law principles.

12.3 Arbitration

Any disputes arising from these Terms or the Service will be resolved through binding arbitration, except where prohibited by law. You waive your right to participate in class action lawsuits or class-wide arbitration.

13. General Provisions

13.1 Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use after changes become effective constitutes acceptance.

13.2 Entire Agreement

These Terms constitute the entire agreement between you and ImageTranslate regarding the Service and supersede all prior agreements.

13.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.

13.4 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

13.5 Assignment

You may not assign these Terms without our consent. We may assign these Terms to any affiliate or successor without notice.
